Terms & Conditions

Introduction

I.

These General Terms of Use are made between the legal entity incorporated under the Companies Act in the name Moneywave Solutions Pvt. Ltd. (hereinafter: the Provider or MWSPay) and you (hereinafter: the Client and/or Merchant).

II.

By registering for, accessing, or using all or any portion of the MWSPay Insurance Portal and its related services (hereinafter: MWSPay Service or Service or Services), the Client and/or Merchant agrees to be legally bound by these Terms and fully accepts all terms stated herein. If the Client and/or Merchant does not accept these Terms, they shall not be entitled to use or distribute the Service.

III.

The Client and/or Merchant agrees to these Terms on behalf of the company or other legal entity for which it is acting (for example, as an employee, agent, or contractor) or, if there is no company or legal entity, on behalf of themselves as an individual. By accepting these Terms the Client and/or Merchant represents and warrants that:

• It has the requisite corporate power and official authority to execute, deliver and perform its obligations under these Terms;
• It has obtained all licenses, authorisations, approvals, consents, or permits required to perform its obligations under these Terms under all applicable laws of all authorities having jurisdiction over the Services;
• The execution and performance of these Terms and the consummation of the transactions contemplated herein have been duly authorised by the requisite corporate action on the part of such Client and/or Merchant if required;
• The execution, delivery, and performance of these Terms does not violate any judgment, order, or decree; a material default under any material contract by which it or any of its material assets are bound; or an event that would, with notice or lapse of time, or both, constitute such a default.

IV.

Other agreements concluded by the Client and/or Merchant with MWSPay, if any, may refer to a separate name of this document. This shall not in any way affect the enforceability of these Terms.

MWSPay provides technology to fetch insurance premium details from partner insurers via BBPS and to initiate premium payments through integrated payment gateways. MWSPay is a technology intermediary — we are not an insurance company, insurer, insurance broker, or payment processor. Insurance policy issuance, acceptance, cancellations, renewals, and claims are governed entirely by the respective insurer's terms and applicable insurance regulations.

4. Authorised Use

Access to the MWSPay Insurance Portal is restricted to registered and authorised users only. You must not:

• Share your login credentials with any other person.
• Use the portal to process payments for policies you are not authorised to handle.
• Attempt to reverse-engineer, scrape, or abuse any API or portal functionality.
• Use the portal for any unlawful, fraudulent, or unauthorised purpose.
• Represent yourself as an employee or agent of MWSPay, any insurer, or BBPS without authorisation.

5. User Obligations

You are responsible for:

• Providing accurate policy numbers and customer details when fetching bills.
• Verifying all bill details — including amount, customer name, and due date — before initiating payment.
• Keeping your account credentials secure and confidential.
• Complying with applicable insurance regulations, BBPS guidelines, and internal compliance policies.
• Immediately reporting any suspected unauthorised access to your account to MWSPay.

6. Accuracy of Information

Bill amounts, due dates, and customer details displayed on this portal are fetched in real time from partner insurers via BBPS. MWSPay does not independently verify or guarantee the accuracy of information returned by insurers. If you believe a bill amount or detail is incorrect, contact the insurer directly before making payment.

7. Payments

Payments are processed by Nimbbl, an independent payment gateway. MWSPay is not the payment processor and does not store card, UPI, or bank account details. All payment disputes, chargebacks, refund requests, and gateway failures are subject to Nimbbl's terms and the issuing bank's policies. Premium payments, once successfully processed, are subject to the respective insurer's confirmation and reconciliation timelines.

8. Limitation of Liability

To the fullest extent permitted by applicable law, MWSPay shall not be liable for:

• Insurer rejection or non-acceptance of premium payments;
• Policy lapse due to delayed settlement by insurers or payment gateways;
• Delays in BBPS bill fetch due to insurer-side downtime or maintenance;
• Indirect, consequential, or incidental losses;
• Losses arising from user error in entering policy numbers, dates of birth, or other details.

9. Termination

MWSPay reserves the right to suspend or terminate portal access for any user who violates these Terms, misuses the platform, engages in fraudulent activity, or fails to comply with applicable laws or regulations. Termination shall not affect the enforceability of any obligations arising prior to termination.

10. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in New Delhi.
